Tunis, February 13, 2025 – The indictment chamber specializing in financial corruption cases at the Court of Appeal in Tunis decided, in its session held on Wednesday, to refuse the release of businessman and former president of football club Etoile du Sahel, Ridha Charfeddine, and to issue a prison warrant against a former president of a well-known sports association, and to refer them to the criminal chamber specializing in financial corruption cases at the Court of First Instance in Tunis.
Details of the case and referrals to the criminal chamber
The indictment chamber at the Court of Appeal in Tunis examined the case of Ridha Charfeddine, who is still in detention pending investigation, along with a number of other defendants who were referred at large, including one of his relatives. Another businessman, a former president of a well-known sports association, is also facing an arrest warrant, as he was referred to the indictment chamber as a wanted suspect.
After deliberations and legal negotiations, the court decided to:
Refer all the accused to the criminal chamber specializing in financial corruption cases at the Tunis Court of First Instance.
Reject the request to release businessman Ridha Charfeddine and keep him in detention.
Issue a prison order against a former president of a sports association.
Case(s) facing Ridha Charfeddine:
Former MP and businessman Ridha Charfeddine faces four cases, including accumulating profits abroad without a license, money laundering, customs and banking violations, and conspiring against state security. Two prison orders were issued against him in the cases of accumulating profits and money laundering, while a settlement was reached in the customs case, and the investigating judge decided to keep him on bail in the case of conspiring against state security.
This case is part of a series of investigations related to suspicions of financial corruption in economic and sports institutions, amid growing concerns about the transparency of these trials and the guarantees of a fair trial.
Calls to ensure the independence of the judiciary
The Freedom for Tunisia Observatory stresses the importance of adhering to transparent legal procedures and ensuring the right of all defendants to defense and a fair trial without any political interference or external influences. It further stresses:
Ensuring respect for the judicial process away from any political or selective exploitation in corruption cases.
Disclosing the details of investigations to enhance public confidence in the integrity of the judiciary.
Protecting the rights of the accused and ensuring that the judiciary is not exploited as a tool to settle political scores.
